Welcome to Dee Escapes. By booking a tour or retreat with us, you agree to the following terms and conditions. Please read them carefully before making a reservation. These terms outline the rights and responsibilities of both parties to ensure a smooth and enjoyable travel experience. By continuing to use our services, you acknowledge that you have read, understood, and agreed to be bound by these terms.

1.0. GENERAL

1.1. Dee Escapes is a tour operator specialising in group tours in Bali, including land activities, scuba/snorkelling trips, and yoga retreats. Our aim is to provide an exceptional travel experience that allows participants to explore Bali’s unique culture, landscapes, and marine life while ensuring a high level of safety and professionalism.

1.2. These terms apply to all bookings made through our official website and form a legally binding agreement between Dee Escapes (“we”, “our”, “us”) and you (“customer”, “you”, “your”). Any deviation from these terms must be agreed upon in writing by both parties.

1.3. We reserve the right to refuse bookings from individuals or groups who fail to comply with our terms, engage in inappropriate behaviour, or pose a risk to the safety and enjoyment of other travellers.

1.4. Our tours operate in compliance with local laws and regulations, and all participants are required to adhere to these legal requirements. Any failure to do so may result in exclusion from activities or the entire tour.

2.0. BOOKINGS AND PAYMENTS

2.1. All bookings must be made via our official website and are subject to availability. Early booking is recommended to secure your place on your preferred tour dates.

2.2. A deposit of £200 is required at the time of booking to secure your place. This deposit is non-refundable. The deposit allows us to make arrangements and secure necessary reservations for your trip.

2.3. The balance payment must be completed by the deadline specified at the time of booking. Failure to complete payment may result in cancellation of your reservation without refund.

2.4. We accept payments only by debit or credit card. Alternative payment methods may be considered upon request and at our discretion.

2.5. All prices quoted on our website are in GBP (£) unless otherwise stated. It is your responsibility to ensure that you are aware of the currency exchange rates if making an international payment.

2.6. Any discounts, promotions, or special offers will be subject to specific terms and conditions and may not be combined with other offers unless explicitly stated.

2.7. We reserve the right to correct pricing errors on our website or promotional materials at any time before confirming your booking.

3.0. CANCELLATION AND REFUND POLICY

3.1. If you cancel your booking more than 21 days before the tour start date, you will receive a full refund minus the £200 deposit. The deposit covers administrative costs and pre-arranged bookings.

3.2. If you cancel within 21 days of the tour start date, no refund will be provided, and 100% of the amount paid will be forfeited.

3.3. If you fail to attend the tour or retreat without prior notice, no refund or rescheduling will be provided.

3.4. Refunds will be processed using the original payment method within 14 business days of receiving a cancellation request.

3.5. You may request a transfer to a future tour date if notified in advance. Such transfers are subject to availability and may incur additional fees.

3.6. We recommend purchasing travel insurance that covers trip cancellations to mitigate financial loss due to unforeseen circumstances.

4.0. CHANGES AND CANCELLATIONS BY US

4.1. We reserve the right to cancel or reschedule a tour due to unforeseen circumstances, including but not limited to natural disasters, government restrictions, or safety concerns.

4.2. If we cancel your tour, you will be offered a full refund or the option to reschedule. We are not responsible for any other costs incurred by you, such as flights or accommodation.

4.3. If significant changes are required to the itinerary, we will notify you as soon as possible. Where feasible, alternative arrangements will be provided.

4.4. In cases where third-party providers (e.g., transport services, accommodation, activity operators) make changes, we will do our best to accommodate equivalent alternatives.

5.0. TRAVEL REQUIREMENTS AND INSURANCE

5.1. It is your responsibility to ensure you have valid travel documents, including passports and visas, if required.

5.2. We strongly recommend that you obtain comprehensive travel insurance covering medical expenses, trip cancellations, and personal belongings.

5.3. We are not liable for any costs or losses incurred due to failure to secure appropriate travel insurance.

6.0. HEALTH AND SAFETY

6.1. Fitness and Physical Requirements: Some of the activities offered, including but not limited to scuba diving, snorkelling, trekking, and yoga, require a reasonable level of physical fitness. It is your responsibility to assess your own ability to safely participate. If you have any doubts about your fitness level, you should consult a medical professional before booking.

6.2. Pre-Existing Medical Conditions: You must disclose any pre-existing medical conditions, disabilities, injuries, allergies, or other health concerns that may affect your ability to participate in activities. If you have any condition that could be triggered or worsened by physical exertion, altitude, marine activities, or any other environmental factor, you must inform us before booking. If a medical issue arises during the tour that was not previously disclosed, we reserve the right to exclude you from certain activities for safety reasons. In cases where participation may pose a risk to yourself or others, we may request a medical clearance letter from your doctor.

6.3. Safety Briefings and Equipment Use: Participants must attend all safety briefings and follow the instructions provided by our guides, instructors, or third-party service providers. Any refusal to comply with safety instructions may result in exclusion from activities without a refund. For activities involving specialised equipment (e.g., scuba diving gear, snorkelling masks, life jackets), you must use the equipment correctly and as instructed. Any loss or damage to provided safety equipment due to negligence will be charged to the participant.

6.4. Alcohol, Drugs, and Substance Use: Consumption of alcohol or drugs before or during any physically demanding activity is strictly prohibited. If you are found under the influence of alcohol or drugs before an activity, you will be denied participation, and no refund will be issued. Certain medications may impair your ability to participate safely. It is your responsibility to check whether any prescribed medication you are taking may impact your ability to engage in tour activities.

6.5. Environmental and Wildlife Considerations: Some of our tours take place in natural environments where exposure to wildlife, insects, and unpredictable weather conditions is possible. It is your responsibility to take appropriate precautions, including using insect repellent, wearing appropriate clothing, and following our guides’ instructions regarding wildlife encounters. Littering or causing environmental damage is strictly prohibited. Participants are expected to respect local ecosystems and dispose of waste responsibly.

6.6. Medical Emergencies and First Aid: While we take all reasonable steps to ensure your safety, we cannot guarantee immediate medical assistance in remote locations. Our guides are trained in basic first aid, but in the event of a serious medical emergency, professional medical assistance may take time to arrive. If emergency evacuation is required due to a medical issue, any associated costs will be the responsibility of the participant. We strongly recommend obtaining travel insurance that covers medical evacuation.

6.7. Personal Responsibility and Assumption of Risk: By participating in our tours, you acknowledge that you are engaging in activities that may carry inherent risks. While we take every precaution to minimise risks, you accept full responsibility for your personal safety. If you choose to disregard any safety instructions or warnings provided, you do so at your own risk. We are not liable for injuries, illnesses, or accidents except in cases where they are directly caused by our proven negligence.

7.0. LIABILITY AND DISCLAIMERS

7.1. General Liability: While Dee Escapes strives to provide a safe, enjoyable, and well-organised travel experience, participation in our tours involves inherent risks. By booking a tour with us, you acknowledge that you are voluntarily participating and accept responsibility for any risks associated with travel, outdoor activities, and participation in adventure experiences. We are only liable for personal injury or death where it is directly caused by our proven negligence.

7.2. Limitation of Liability: We shall not be liable for any indirect, special, or consequential loss or damage, including but not limited to loss of enjoyment, loss of opportunity, loss of earnings, or loss of personal belongings. Our liability, in any case, shall not exceed the total cost of the tour paid by you.

7.3. Third-Party Service Providers: Some elements of your tour, including but not limited to transport, accommodation, and specific activities (e.g., scuba diving, yoga instruction, boat trips), may be provided by independent third-party operators. While we carefully select and work with reliable partners, we do not accept liability for the acts, omissions, or negligence of these third parties. Any claims or disputes arising from third-party services must be addressed directly with the relevant service provider. We shall not be responsible for any dissatisfaction, delays, accidents, injuries, or losses caused by third-party service providers.

7.4. Force Majeure: We shall not be liable for any failure to perform or any delay in performing our obligations under these terms due to events beyond our control. Such events include but are not limited to natural disasters, pandemics, acts of terrorism, civil unrest, strikes, government restrictions, or extreme weather conditions. In such cases, we will make reasonable efforts to offer an alternative tour date or refund any recoverable costs.

7.5. Personal Belongings and Security: We are not liable for the loss, theft, or damage of any personal property, including but not limited to luggage, cash, electronic devices, and travel documents. Participants are advised to take necessary precautions to safeguard their belongings and to use any secure storage options provided during the tour.

8.0. CODE OF CONDUCT

8.1. Respect for Guides, Staff, and Fellow Participants: Our guides and staff are there to ensure your safety and enjoyment. You must follow their instructions at all times. Any behaviour that undermines the authority of our guides, including refusing to follow safety instructions or engaging in arguments, will not be tolerated. Participants must respect the space, privacy, and personal boundaries of others. Any form of harassment, including verbal, physical, or sexual harassment, will result in immediate removal from the tour without refund.

8.2. Alcohol and Drug Policy: The consumption of alcohol is permitted in moderation, provided it does not interfere with the safety, enjoyment, or comfort of others. Excessive intoxication that leads to disruptive behaviour, safety risks, or failure to comply with instructions may result in removal from activities or the tour. The possession, use, or distribution of illegal drugs is strictly prohibited. Any participant found in possession of illegal substances will be removed from the tour immediately, and local law enforcement may be notified.

8.3. Environmental Responsibility and Sustainability: Participants must respect the natural environment by avoiding littering, minimising plastic waste, and using designated waste disposal facilities. Wildlife must be observed from a safe and respectful distance. Feeding, touching, or disturbing animals is strictly prohibited unless part of a supervised and ethical wildlife experience. Coral reefs, marine life, and natural habitats must not be damaged or removed. When engaging in snorkelling or scuba diving, participants must avoid touching coral and follow responsible diving practices. 

8.4. Respect for Local Communities and Cultures: Participants are expected to engage with local communities in a respectful and responsible manner. Dress codes should be adhered to in culturally sensitive areas, including temples and religious sites. Participants must avoid taking intrusive photographs of local people without permission. The use of offensive language, gestures, or behaviour that disrespects local traditions and beliefs is strictly prohibited.

8.5. Accommodation and Shared Spaces: Participants must respect shared spaces, including hotels, guesthouses, and transport vehicles. Noise levels should be kept to a minimum, especially during early morning and late-night hours. Theft, vandalism, or damage to property belonging to accommodation providers or other participants will not be tolerated. Any damage caused by a participant must be paid for by the responsible individual.

8.6. Compliance with Local Laws and Regulations: All participants must adhere to local laws in the country of travel. Illegal activities, including theft, assault, vandalism, or public disturbances, will result in immediate removal from the tour and may be reported to local authorities. Participants are responsible for ensuring that they have the appropriate visas, permits, and travel documents before travelling.

8.7. Safety and Security: Participants must prioritise their own safety and the safety of others. Engaging in reckless behaviour that endangers oneself or others, including ignoring safety briefings or venturing into restricted areas, is strictly prohibited. Participants must inform tour guides of any safety concerns or incidents as soon as they arise.

8.8. Consequences of Breach of Code of Conduct: Any breach of the Code of Conduct may result in a verbal or written warning. Serious or repeated violations may result in removal from certain activities, exclusion from the tour, or a ban from future Dee Escapes experiences. No refunds will be provided for participants removed from a tour due to misconduct. If removal from the tour is required, the participant will be responsible for making their own arrangements, including return travel.

9.0. PHOTO AND MEDIA CONSENT

9.1. During the tour, we may take photographs or videos of participants for promotional purposes. By booking a tour, you consent to your image being used in our marketing materials, including our website and social media.

9.2. If you do not wish to be included in such media, please inform us in writing before the start of the tour.

10.0. MISCELLANEOUS

10.1. Governing Law and Jurisdiction: These Terms and Conditions and any disputes or claims arising from or in connection with them shall be governed by and construed in accordance with the laws of England and Wales. Any disputes or claims that cannot be resolved amicably shall be subject to the exclusive jurisdiction of the courts of England and Wales. If you are a consumer residing outside England and Wales, you may also have rights under the consumer protection laws of your country of residence.

10.2. Entire Agreement: These Terms and Conditions, together with our Privacy Policy, Booking Terms, and any other written agreements between you and Dee Escapes, constitute the entire agreement between you and us. They supersede all prior agreements, understandings, or representations, whether written or oral, relating to your participation in our tours and services. No other warranties, terms, or representations (express or implied) shall form part of this agreement unless explicitly agreed in writing by both parties.

10.3. Privacy Policy and Data Protection: Our collection and use of personal data are governed by our Privacy Policy, which complies with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018. By using our services, you acknowledge that you have read and understood our Privacy Policy and consent to the processing of your personal data as outlined therein. 10.4. Severability: If any provision of these Terms and Conditions is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be deemed severed from the agreement. The remainder of the Terms and Conditions shall remain in full force and effect.

10.5. No Waiver: Failure or delay by Dee Escapes to enforce any provision of these Terms and Conditions shall not be construed as a waiver of our rights. Any waiver of any provision must be explicitly stated in writing and signed by an authorised representative of Dee Escapes.

10.6. Assignment: You may not assign, transfer, or subcontract any of your rights or obligations under these Terms and Conditions without our prior written consent. We may assign or transfer our rights and obligations under these Terms and Conditions in the event of a business restructuring, sale, or transfer of operations.

10.7. Amendments and Modifications: We reserve the right to amend, modify, or update these Terms and Conditions at any time. Any changes will be posted on our website and will take effect immediately for new bookings. If you have an existing booking, we will notify you of any material changes that may affect your rights.

10.8. Third-Party Rights: Unless explicitly stated otherwise, no person other than the parties to this agreement shall have any rights to enforce any terms under the Contracts (Rights of Third Parties) Act 1999.
